1. Agreement to Terms

By booking lessons with Prime Pathway Learning Ltd ("Prime Pathway", "we", "us", "our"), you ("student", "parent", "guardian", "you") agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services Provided

Prime Pathway provides online tutoring services for:

  • 11+ entrance exam preparation
  • GCSE subjects (all major exam boards including AQA, Edexcel, OCR, CAIE)
  • A level subjects (AQA, Edexcel, OCR)

Services include one-to-one online lessons, custom learning materials, mock exam papers, and progress feedback. All lessons are delivered via secure online platforms (e.g., Zoom, Microsoft Teams).

3. Eligibility

Students under 18 must have parental or guardian consent to use our services. Parents/guardians are responsible for ensuring accurate information is provided during booking.

4. Booking and Pricing

4.1 Taster Lesson

The £20 introductory taster lesson is a one-time offer per student. It includes a 60-minute lesson and a mini diagnostic to assess learning needs.

4.2 Payment Plans

After the taster lesson, you may choose from:

  • Pay as you go: Book and pay for individual lessons as needed
  • Growth plan: Regular lessons billed monthly (e.g., £128/month for 4 GCSE lessons)
  • Results plan: Intensive support billed monthly (e.g., £240/month for 8 GCSE lessons)

Prices vary by level (GCSE/11+ vs A level). Current pricing is available on our website.

4.3 Payment

  • All prices are in GBP (£) and include VAT where applicable
  • Payment is due before or at the time of lesson delivery
  • Monthly plans are billed in advance at the start of each billing cycle
  • We accept payment via [payment methods to be specified]
  • Failure to pay may result in suspension of services

5. Cancellation and Rescheduling

5.1 Student Cancellations

  • 24+ hours notice: Full credit or refund
  • Less than 24 hours: No refund unless exceptional circumstances (illness, emergency)
  • No-shows: Lesson is forfeited and charged in full

5.2 Tutor Cancellations

If your tutor cancels, we will offer a replacement slot or full refund. We aim to provide at least 24 hours notice but may cancel with less notice in emergencies.

5.3 Monthly Plan Cancellations

  • Growth and Results plans require 7 days written notice to cancel
  • Cancellation takes effect at the end of the current billing cycle
  • No refunds for partial months unless we fail to deliver agreed services

6. Tutor Allocation and Changes

  • We match students with tutors based on subject, level, and availability
  • We cannot guarantee a specific tutor but will try to maintain consistency
  • If you wish to change tutors, contact us and we will arrange an alternative where possible
  • Monthly plan holders receive priority access to their preferred tutor

7. Lesson Conduct and Expectations

7.1 Student Responsibilities

  • Arrive on time with necessary materials (notebook, past papers, etc.)
  • Engage respectfully with tutors
  • Complete any agreed practice work between sessions
  • Ensure a suitable learning environment (quiet space, stable internet)

7.2 Tutor Responsibilities

  • Deliver lessons as scheduled
  • Prepare subject-specific materials and mock papers as needed
  • Provide clear feedback and lesson recaps
  • Maintain professional conduct at all times

7.3 Safeguarding

  • All tutors hold Enhanced DBS checks
  • Parents/guardians may join lessons at any time
  • Lessons take place on secure, monitored platforms
  • Any safeguarding concerns will be reported in line with UK safeguarding guidance

8. Intellectual Property

  • All custom materials (mock papers, lesson notes, resources) remain our intellectual property
  • You may use materials for personal study but not redistribute or commercialise them
  • Our website content, branding, and logos are protected by copyright

9. Limitation of Liability

We provide tutoring services to support learning but cannot guarantee specific exam results or grade improvements. Student outcomes depend on many factors including effort, school teaching, and exam performance on the day.

To the fullest extent permitted by law:

  • We are not liable for indirect, consequential, or incidental damages
  • Our total liability is limited to the amount you paid for the specific service in question
  • We are not responsible for third-party platform failures (e.g., Zoom outages)

Nothing in these terms excludes liability for death/personal injury caused by negligence, fraud, or other liabilities that cannot be excluded by law.

10. Technical Requirements

You are responsible for ensuring you have:

  • A reliable internet connection
  • A device with camera and microphone (laptop, tablet, or computer)
  • Access to the lesson platform (we will provide instructions)

We are not responsible for technical issues on your end, but will work with you to reschedule if problems persist.

11. Data Protection

We process your personal data in accordance with our Privacy Policy and UK GDPR. By using our services, you consent to such processing. See our Privacy Policy for full details.

12. Complaints and Disputes

If you are unhappy with our services, please contact us. We will investigate and respond within 14 days. If we cannot resolve the issue, you may refer the matter to an independent dispute resolution service or seek legal advice.

13. Termination

We reserve the right to terminate services immediately if:

  • You breach these terms
  • You engage in abusive or threatening behaviour toward tutors or staff
  • Payments are repeatedly overdue
  • We suspect fraudulent activity

You may terminate services at any time by following the cancellation process outlined in section 5.

14. Changes to Terms

We may update these Terms of Service from time to time. Significant changes will be communicated via email or a notice on our website. Continued use of our services after changes constitutes acceptance.

15. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
